Hibb, there are always limits when it comes to constitutionally protected rights.
ORS 166.155 is an intent statue. It criminalizes intent, which is a very common aggravating factor in criminal law dating well back in the history and tradition of western legal principles.
It's application in this instance will depend on the totality of circumstances. Given the cursory description included in the news report here, it appears probable that those circumstances adequately support the conclusion of criminal intent as described in the statute.
