I can't say how the case should be resolved.
But it does appear that the dog's owner was in a catch-22 situation with the fence. And that regardless of the substance of the dog issues, there may be another side to the story regarding human behavior.
This allegation of perjury is serious:
“Captain Fessler knew the statement, which implicated all four of my dogs in a dogs at large/vicious dog incident to be erroneous when he used it under oath, which is perjury,” Atwood said.

The news story didn't say whether the dogs' owner is represented by an attorney. My advice is that if she isn't already represented, she should find a good attorney.
