Mr. Risdon's proposed dispensary location is entirely within a school buffer exclusion zone. The location is within 1000 feet of McMinnville School District property as shown by the Oregon Health Authority's map. The map can be found here: http://navigator.state.or.us/apps/schools_locator/index.html

If you type in the address 807 NW Adams the location appears entirely within the pink zone where dispensaries are not allowed. The Oregon Health Authority has indicated that they will not approve this location. They may be reached at 855-244-9580 (Monday-Friday, 11 am to 4 pm).

Don't know about "entirely" it's eitger partially or not at all. An the only reason it is in the buffer zone, if it is, is due to the tennis courts at 12th & cowls.

What happened to free market? Free enterprise? If the area really can't support the "absurd" amount of pot shops popping up, guess what, they'll go outta business.

Do you only support free enterprise for tacabaco, spirits, & wine bars?


in other news; congrats to encore & the Elliot family. It was cool to see the kiddos getting involved in helping mom spread the barks dust and the team effort in the exterior facelift. Kuddos on utilizing local contractors and not low bid Portland or salem gigs!

Concerned -- The buffer is 'school proximity' (emphasis 'school'). Nowhere in the description does the state refer to 'school property'. Property owned by the district on Hill Road has no buffer (yet).

If you enlarge the map (and employ the measuring tool), the new business is not within the state's 'pink circle' (400+ feet outside).

Mr. Dix- The tennis court buffer is considered a school buffer, which is governed by Oregon Administrative rule 333-008-1110(2), which states:

(2) For purposes of implementing ORS 475B.450(3)(d), the Authority will consider a location to be a school if it has at least the following characteristics:
(a) Is a public or private elementary or secondary school as those terms are defined OAR 333-008-0010;
(b) There is a building or physical space where students gather together for education purposes on a regular basis;
(c) A curriculum is provided;
(d) Attendance is compulsory under ORS 339.020 or children are being taught as described in ORS 339.030(1)(a); and
(e) Individuals are present to teach or guide student education.

Since that location is a physical space owned by the school district, where students gather together for education purposes on a regular basis, with a provided curriculum, and teachers present, it was determined that a school buffer needed to be placed around that location. The Hill Road location does not have a buffer because it does not meet the definition of school property until a school is built or children gather there for educational purposes.

The state has been updating their map and currently that buffer along with the location of two current dispensaries in town are not shown. Once the map is fixed you will see that that the new business is in fact located entirely within the buffer, and is approximately 100 feet inside of the buffer, as confirmed by the OHA investigator in charge of the application.
