What a despicable miscarriage of justice hidden in the fine print. I remember that horrific crime and the trial. Sparks is a monster.

So the rape & murder of a 12 year old doesn’t qualify for the death penalty?......what crime could deserve it more?

Tagup, the issue is that the law has changed. It now requires prosecutors to prove that the crime was premeditated. That wasn't required in 1999, and so it wasn't part of the charges. The new law now applies because he has been found entitled to a new sentencing trial.
